Individuals
Pahl & Associates can help you in a variety of ways if you are making an application to the UK authorities, whether you are doing so from within the UK or from abroad.

Making an initial application in the UK or abroad
The quality of an initial application can make the difference between the success and failure of that application. Whether you wish to apply to come to the UK, remain here for longer than your current visa permits, or to stay on some other basis ('switch' categories), when you instruct us we will:

  1. Give you an assessment of the merits of your case and advise you on the best course of action
  2. Inform you of the legal requirements which you will have to meet for your application to be successful
  3. Explain how the legal requirements will be interpreted by the UK authorities, based on the internal instructions given to their caseworkers
  4. Complete the application form on your behalf based on the information you give us
  5. Give you detailed advice about the supporting evidence you should provide to support your application
  6. Submit your application form along with all evidence and with legal representations on your behalf. In the legal representations we will set out the particulars of your case and circumstances, details of the law under which you are asking for your application to be considered, and show how you meet the requirements of the law, or, if you do not meet the requirements, present your case in the best possible light and explain in legal terms why your application should be successful.
  7. Liaise with the appropriate authorities until a decision on your application is received.
 
We undertake the following services for the benefit of our clients:
  1. Entry Clearance Applications - Advising on how to make a successful application as a visitor, settlement, marriage, student and others.
  2. Advocacy and Appeal Representation - We represent client at the Asylum and Immigration Tribunal at appeals against any Immigration decision - visitors, settlement (spouses/partners) students and others.
  3. Human Rights Claims - Advising on your rights under the ECHR and HRA, original claims, appeal against refusal, and further representations.
  4. Students Visa Application and/or extension of leave to remain - Advising on how to make valid student visa applications, applications for the extension of leave to remain as students, an appeal against refusal of extension to remain as a student.
  5. Business Immigration - Business visitors; representatives of overseas firms applications; ministers of religion; establishment of business; investors and innovators.
  6. Marriage Application - Advising those who can get married under the Immigration Rules or remain a partners.
  7. Employment under the Work Permit Scheme - Application for work permit and the Points Based System - PBS Managed Migrant Scheme route.
  8. EU Nationals (your rights arising out of the EU Law including your spouse and dependants and extended family member who can qualify for leave to remain and indefinite leave to remain in the UK.
  9. Overstayers - We advise as to your rights under the 5, 7, 10 and 14 years Home Office policy and concession options that may lead to indefinite leave to remain in the UK.
  10. Detention Centre/Airport Representation - We represent clients at airports, detention/removal centres, bail application when required.
  11. Citizenship and Naturalization Applications - We advise on your qualification, law and procedure for British citizenship and naturalization applications.
 
ILR - Indefinite leave to remain

Indefinite Leave to Remain (also known as settlement or permanent residence) means that the UK Government no longer places any restrictions on your conditions of stay in the UK.


It is also a vital step towards obtaining UK nationality.

Depending on your visa category you will qualify in a number of ways:

  1. Work Permit Visa: by spending a period of five years in the UK
  2. HSMP/Tier 1 Visa: by spending a period of five years in the UK
  3. Marriage/Unmarried Partner/Civil Partner Visa: by spending a period of two years in the UK.
  4. Business Category Visa: by spending a period of five years in the UK
  5. Ancestry Visa: by spending a period of five years in the UK
  6. Writers, Composers or Artists Visa: by spending a period of five years in the UK
  7. EEA citizen: by spending a period of five years exercising EC Treaty rights in the UK
  8. Lawful stay on any basis: by spending a period of 10 years in the UK.
  9. Unlawful stay or partly unlawful stay: by spending a period of 14 years in the United Kingdom

To apply for indefinite leave to remain you must submit an application form to the Home Office along with the necessary documents and enclosures to prove that you have been in the UK for the required period of time and fulfilled all necessary conditions. You may qualify to use our same-day processing service.

Do remember that our practice is registered with The Office of the Immigration Services Commissioner (OISC), an independent public body set up under the Immigration and Asylum Act 1999. The OISC is responsible for ensuring that all immigration advisers fulfil the requirements of good practice.
